Terms of Use

IMPORTANT: SECTION 14 (ARBITRATION; CLASS ACTION WAIVER) AFFECTS YOUR LEGAL RIGHTS. PLEASE READ IT CAREFULLY.

These Terms of Use (“Terms”) form a binding agreement between you and Trevio (“Trevio,” “we,” “us,” or “our”) and govern your access to and use of the Trevio mobile app, website, APIs, push notifications, and any other Trevio product or service (collectively, the “Service”). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (16 in the EU/EEA where required) and capable of entering a binding contract under the law of your jurisdiction. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to that organization. The Service is not intended for use by anyone prohibited from receiving it under U.S. or other applicable law.

2. Your account

  • You are responsible for the activity that happens under your account and for keeping your login credentials confidential.
  • You must promptly notify us at security@trevio.app if you suspect unauthorized access.
  • You may close your account at any time from Settings → Delete account. Closing your account does not relieve you of obligations accrued before closure (for example, unpaid fees).

3. Your content

You retain ownership of the content you submit to the Service (photos, voice clips, notes, links, person profiles, and anything else you create or upload — collectively, “Your Content”). You grant Trevio a worldwide, non-exclusive, royalty-free, sublicensable license to host, copy, transmit, process, display, and adapt Your Content solely to operate, secure, and improve the Service for you (including generating AI summaries, reminders, and search indexes). This license ends when Your Content is deleted from our active systems, subject to limited residual copies in routine backups that roll over.

You represent and warrant that you own or otherwise have all rights necessary to share Your Content, and that Your Content and its use under these Terms do not violate any third-party right or law.

4. AI features and recall suggestions

The Service uses third-party large language models (currently Google Gemini and Anthropic Claude) and other automated tools to generate summaries, suggestions, person profiles, link previews, and gift recommendations. These outputs:

  • Are generated probabilistically and may be inaccurate, incomplete, biased, out of date, or otherwise wrong.
  • Are not professional advice. Trevio is not a medical, legal, financial, mental-health, accounting, or other professional adviser, and AI outputs in the Service must not be relied on as such.
  • Should not be relied on for decisions that could cause harm (including but not limited to medical, legal, safety, or financial decisions) without independent verification.

You are solely responsible for reviewing AI outputs before acting on them. We disclaim all liability for actions taken or not taken in reliance on AI-generated content to the maximum extent permitted by law.

5. Acceptable use

You will not, and will not permit anyone else to:

  • Use the Service to upload, store, or transmit content that is unlawful, harmful, infringing, defamatory, harassing, discriminatory, obscene, sexually explicit involving minors, or otherwise objectionable.
  • Impersonate any person or misrepresent your affiliation with any person or entity.
  • Harvest, scrape, or copy data from the Service except through the documented API for your own account.
  • Reverse-engineer, decompile, or attempt to derive source code from the Service except as permitted by applicable law.
  • Probe, scan, or test the vulnerability of the Service, or interfere with its security, integrity, or availability (including by uploading malware, sending spam, or running denial-of-service attacks).
  • Use the Service to build a competing product or to train machine-learning models.
  • Resell, rent, lease, or sublicense the Service except through a Trevio-authorized program.
  • Use the Service in violation of any applicable law, regulation, or third-party right.

We may suspend or terminate your access immediately if you violate this Section.

5.1 Zero tolerance for objectionable content and abusive users

Trevio has zero tolerance for objectionable content and abusive behavior. Wherever you can interact with another person — sharing a memory with a friend, leaving an echo, or posting in a shopping session — you can:

  • Report it. Use the report action on any shared item, echo, post, comment, or profile, or reach us through the contact details in these Terms.
  • Block anyone. Blocking a user immediately removes the connection and stops them from contacting you, sharing with you, or seeing your content.
  • Remove content. You can delete your own posts and comments, and a session owner can remove a member or their content.

We review reports and act on confirmed violations — removing the content and, where warranted, the account — within 24 hours.

6. Third-party services and links

The Service integrates with third-party platforms (including Apple, Google, Anthropic, Stripe, Clerk, Expo, SerpApi, Instagram, Facebook, Twitter/X, and others). These third parties are not under our control. We make no representations about them, are not responsible for their content, policies, or practices, and may add, remove, or change integrations at any time. Your interactions with third parties are governed by their own terms and policies.

6.1 Text messaging (SMS/MMS) program

If you add and confirm your mobile number in the app, you consent to receive transactional, account-related text messages (SMS/MMS) from Trevio: a one-time welcome, confirmations when you text a link to save it, and replies to your requests such as HELP. This is not a marketing program. Message frequency varies. Message and data rates may apply.

You can cancel at any time by replying STOP to any Trevio text; we will send a single confirmation and then stop messaging you. Reply HELP for help, or email support@trevio.app. We do not share your mobile number or opt-in data with third parties or affiliates for their marketing purposes; numbers are shared only with the carriers and messaging providers (such as Twilio) that deliver the texts. Carriers are not liable for delayed or undelivered messages. Supported carriers may change without notice.

7. Subscriptions, billing, and refunds

  • Subscriptions auto-renew at the end of each billing period until canceled.
  • For subscriptions purchased through Apple In-App Purchase, all billing, refund, and cancellation rules are governed by Apple's standard policies and are managed in your Apple ID settings.
  • For subscriptions purchased through our website (Stripe), you can cancel at any time from Settings; cancellation takes effect at the end of the current billing period and no partial refunds are provided except where required by law.
  • We may change prices, feature availability, or tier allocations on at least 30 days' notice. Continued use after the change takes effect constitutes acceptance.
  • Taxes are not included in displayed prices unless explicitly stated. You are responsible for any taxes applicable to your purchase.

8. Intellectual property

The Service, including all underlying software, designs, logos, text, graphics, and trademarks, is owned by Trevio or our licensors and is protected by intellectual-property laws. These Terms do not grant you any rights to our trademarks or branding.

9. Copyright (DMCA)

We respect intellectual property and respond to valid DMCA notices. If you believe content on the Service infringes your copyright, send a notice that includes (i) a physical or electronic signature, (ii) identification of the copyrighted work, (iii) the URL of the allegedly infringing material, (iv) your contact information, (v) a good-faith statement that the use is unauthorized, and (vi) a statement under penalty of perjury that the information is accurate and that you are the owner or authorized agent. Send the notice to dmca@trevio.app. We will respond as required by the DMCA. Repeat infringers will be terminated.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Without limiting the foregoing, we do not warrant that the Service will be uninterrupted, secure, error-free, or free of viruses, that any data will be preserved, that any AI output will be accurate, or that any reminder will be delivered at a specific time. Your sole remedy for dissatisfaction with the Service is to stop using it.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TREVIO OR ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR OTHER LEGAL THEORY, AND WHETHER OR NOT TREVIO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TREVIO'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO TREVIO IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) USD $50.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You will defend, indemnify, and hold harmless Trevio and its officers, directors, employees, and agents from any third-party claim, demand, or damages (including reasonable attorneys' fees) arising out of or related to (i) Your Content, (ii) your use of the Service, (iii) your violation of these Terms, or (iv) your violation of any law or third-party right.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access (in whole or in part), at any time, with or without notice, if we reasonably believe that (i) you have violated these Terms, (ii) your use creates legal exposure or security risk for Trevio or other users, or (iii) we are discontinuing the Service or a feature. Sections 3, 4, 5, 7–17 survive termination.

14. Arbitration; class-action waiver

READ THIS SECTION CAREFULLY. IT REQUIRES YOU TO ARBITRATE DISPUTES WITH TREVIO AND LIMITS THE WAY YOU CAN SEEK RELIEF.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service (a “Dispute”) will be resolved by final, binding arbitration administered by JAMS under its Streamlined Arbitration Rules then in effect, except that either party may bring an individual action in small-claims court for Disputes within the scope of that court's jurisdiction. The arbitration will take place in San Francisco, California, or, at your election, by telephone or videoconference. The arbitrator's decision is final and enforceable in any court of competent jurisdiction.

YOU AND TREVIO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE, OR PRIVATE-ATTORNEY-GENERAL ACTION. The arbitrator may not consolidate more than one person's claims or preside over any form of representative or class proceeding.

Opt-out. You may opt out of this arbitration section by sending written notice to legal@trevio.app within 30 days of first accepting these Terms. Opt-out is effective only if it includes your name, account email, and a clear statement that you opt out of arbitration.

15. Governing law and venue

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. Any Dispute not subject to arbitration will be brought exclusively in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction in those courts. If you reside in the EU/EEA, nothing in this Section deprives you of mandatory consumer protections under the law of your country of residence.

16. Apple-specific terms (iOS app)

These additional terms apply to your use of the Trevio iOS app downloaded from the Apple App Store:

  • These Terms are between you and Trevio only — not with Apple. Apple is not responsible for the iOS app or its content.
  • The license granted to you is limited to a non-transferable license to use the iOS app on any Apple-branded device that you own or control, as permitted by the Apple App Store Terms of Service.
  • Apple has no obligation to provide maintenance or support for the iOS app and no obligation to handle warranty claims; any warranty claims will be made to Trevio.
  • Apple is a third-party beneficiary of these Terms and may enforce them against you.
  • You represent that you are not located in a country subject to a U.S. government embargo or designated as a “terrorist-supporting” country, and that you are not on any U.S. government list of prohibited or restricted parties.

17. Miscellaneous

  • Entire agreement. These Terms (with the Privacy Policy) are the complete agreement between you and Trevio about the Service and supersede any prior understandings.
  • Severability. If any provision is unenforceable, the rest of the Terms remain in effect.
  • No waiver. Our failure to enforce a provision does not waive it.
  • Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, financing, or sale of assets.
  • Force majeure. We are not liable for any delay or failure of performance caused by events outside our reasonable control.
  • Changes. We may update these Terms; material changes will be highlighted in the Service or by email at least 7 days before they take effect. Your continued use after the effective date constitutes acceptance.
